Attorney Profile
Robert Miranda has been licensed as an attorney with the California State Bar since 1982. Since graduating from U.C. Berkeley School of Law, Boalt Hall, Mr. Miranda's experience includes instructing Stanford law school students as a clinical supervising attorney and prosecuting criminal defendants as a Deputy District Attorney.
MAJOR AREAS OF PRACTICE
Trust and Probate Litigation
Specifically, my practice focus is resolving family situations before it escalates into a costly court lawsuit. I have litigated numerous trials as a Deputy District Attorney and I enjoy being in trial but I also believe it is best to resolve a case if a reasonable settlement can be reached.
Probate litigation regarding trusts, wills, conservatorships and other probate matters can be very expensive and no reasonable person wants to see the estate assets spent on professional fees. On the other hand, Mr. Miranda.s involvement can avoid the necessity and costs of litigation through pre- litigation negotiation and resolution.
If a settlement cannot be reached then Mr. Miranda will assertively represent you in court. When you retain the Law Offices of Robert Miranda, Mr. Miranda will begin with a thorough analysis of your legal situation and pay special attention to factual accuracy and detail.
As a past Deputy District Attorney, Mr. Miranda has had extensive trial experience in prosecuting criminal defendants. Mr. Miranda knows the key to winning trials is diligent preparation and an assertive attitude in the courtroom. Over the past 27 years, Mr. Miranda has acquired the "in court" trial skills that allow him to capably present and advocate your position to the court while responding to opposing counsel's courtroom arguments.
Conservatorships
We can request the court to establish a conservatorship for a loved one who may need assistance with taking care of themselves and their assets. We can also ensure that the conservatee's right are preserved and help him/her appoint a new conservator if they are dissatisfied with their current conservator. We also represent family members or other parties who feel that a change in the present conservator is in the best interests of their loved one.
Let us be of assistance to you. We would welcome an opportunity to meet you and to explain what we can do for you if you have questions regarding Probate Litigation, Will Contests, Trust Litigation, Mental Capacity, Fraud, Undue Influence, Duress, Removal of a Trustee or Conservator, Conservatorships, Financial Elder Abuse, and Mismanagement of Assets.
